Terms of Service for Private Commissions
01 General Terms
Prices are subject to change based on demand.
I have the right to reject any order for any reason.
02 Payment
Currency accepted is USD and can be paid by credit card or PayPal.
Commissions can be paid 100% upfront or 50% up front and 50% after sketch approval.
Please do not send me money before I have accepted your commission.
03 Process & Delivery
The time it takes to complete a private commission varies from 1-4 weeks, depending on size, complexity, and my current health.
Once the piece is completed, I will send you the agreed-upon deliverable: a high-resolution digital image, or the original artwork shipped to your address.
04 Revisions
You will be given 1 free opportunity to make changes to the artwork after we agree upon the concept sketch.
A fee will be added if you want me to change something on the final drawing. This amount depends on the complexity of the change and is based on an estimation of how many additional hours it will require to do.
If your reference is unclear to start with, changes will come at an extra charge.
05 Copyright & Usage
I, Erica Roberts, (the artist):
I reserve the right to cancel and refund the order at any time for any reason.
I retain all copyrights over the commissioned artwork.
I retain the right to profit further from the commissioned artwork.
I reserve the right to post the commissioned artwork online, in my portfolio, as well as in publications such as art books.
You, (the customer/commissioner):
You may upload the commissioned artwork on any website and social channels.
You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.)
You may NOT use the commissioned artwork for commercial purposes.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially, meaning, making money off of it in any way not excluded from these terms.
Claiming the artwork as your own.
Altering the artwork without my consent.
In some cases, the commercial rights to the image may be purchased.
06 Cancellation & Refund Policy
The buyer is not allowed a refund once I start working on the commission.
If for any reason I am unable to start your commission, you will receive a full refund.
What do you get?
Drafts/mockups of the concept. You must decide which one I should continue with. The number of drafts will vary, based on the complexity of the concept.
Sketch and/or final sketch that you must accept before I continue the work.
Insight and involvement in color plan, depending on the complexity of the piece.
High-resolution digital image of the artwork or the original artwork itself, whatever is the agreed-upon deliverable.
